1. Agreement 

These Terms of Service (“Terms”) govern your use of Sofy (the “Service”), operated by THD Infinity (“we,” “us,” or “our”). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service. 

2. The Service 

Sofy is an AI-powered messaging assistant for beauty and nail salons. We help salon owners automatically respond to customer messages received through Instagram, manage their business information, and operate their salon more efficiently. 

3. Eligibility 

To use the Service, you must: 

• Be at least 18 years old 

• Have the legal authority to enter into these Terms on behalf of your business 

• Operate a legitimate beauty, nail, or related salon business 

• Comply with all applicable laws 

• Comply with Meta’s Platform Terms and the Instagram Platform Policy 

4. Accounts 

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. Notify us immediately if you suspect unauthorized access. We are not liable for losses caused by your failure to protect your credentials. 

5. Instagram Connection 

The Service requires you to connect a valid Instagram Business or Creator account via Meta’s authentication flow. By connecting your account, you grant Sofy permission to: 

• Read incoming Direct Messages sent to your Instagram account 

• Send replies on your behalf via Instagram’s Messaging API 

• Access basic account information (account ID, username) 

• Manage comments on your posts, if enabled 

You can disconnect your Instagram account at any time from your dashboard or by revoking app permissions in your Instagram settings. You remain responsible for the content of messages sent on your behalf through the Service. 

6. AI-Generated Content 

The Service uses automated and artificial intelligence technologies to generate replies to customer messages based on business information you provide. You acknowledge and agree that: 

• AI-generated replies are produced automatically and may occasionally contain errors or unexpected content 

• You are responsible for the business information you provide; the Service relies on this data to respond accurately 

• You are responsible for reviewing and monitoring replies sent on your behalf 

• You may pause or disable automated replies at any time from your dashboard 

• We do not guarantee that replies will perfectly represent your business or always be appropriate; you assume the risk of using automated messaging 

7. Your Content and Data 

You retain all rights to the business information, messages, voice notes, and images you provide (“Your Content”). By using the Service, you grant us a limited, non-exclusive license to use Your Content solely for the purpose of operating and improving the Service. You represent that Your Content does not infringe any third-party rights and complies with applicable laws. 

8. Acceptable Use 

You agree NOT to: 

• Use the Service for unlawful, harmful, deceptive, or fraudulent purposes 

• Use the Service to send spam, harass, threaten, or harm others 

• Violate Meta’s Platform Terms, Instagram Platform Policy, or Community Guidelines 

• Attempt to reverse-engineer, hack, or circumvent the Service’s security 

• Resell or sublicense the Service without our written permission 

• Send unsolicited messages to people who have not contacted your salon first 

• Impersonate any person or entity 

• Upload or transmit malicious code or harmful content 

• Violate any applicable consumer protection, advertising, or anti-spam law 

We reserve the right to suspend or terminate accounts that violate these terms. 

9. Subscriptions and Payment 

Some features of the Service require a paid subscription. By subscribing, you authorize us (and our payment processor) to charge the applicable fees on a recurring basis until you cancel. 

• Subscriptions auto-renew unless cancelled before the renewal date 

• Fees are non-refundable except where required by law or as specifically stated 

• We may change pricing with at least 30 days’ notice; changes apply to the next billing cycle 

• You can cancel at any time from your dashboard; cancellation takes effect at the end of the current billing period 

10. Free Trials 

We may offer free trials. At the end of a trial, your subscription will automatically convert to a paid plan unless cancelled. We will notify you before charging. 

11. Termination 

You may delete your account at any time. We may suspend or terminate your account if you violate these Terms, fail to pay, or engage in fraudulent or abusive behavior. Upon termination, your access ends, we delete or anonymize your data per our Privacy Policy, and provisions that by their nature should survive will continue to apply. 

12. Intellectual Property 

The Service, including its software, design, content, and trademarks, is owned by THD Infinity and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable license to use the Service in accordance with these Terms. All rights not expressly granted are reserved. 

13. Disclaimers 

The Service is provided “as is” and “as available” without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure, or that automated replies will be accurate or appropriate. 

14. Limitation of Liability 

To the maximum extent permitted by law, THD Infinity shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or business, arising from your use of the Service. Our total liability for any claim will not exceed the greater of (a) the fees you paid us in the 12 months preceding the claim, or (b) USD $100. 

15. Indemnification 

You agree to indemnify and hold THD Infinity harmless from any claims, damages, or expenses (including legal fees) arising from your use of the Service, your violation of these Terms, your content, or your violation of any third-party rights. 

16. Third-Party Services 

The Service integrates with third parties including Meta and Instagram. Your use of these third parties is subject to their own terms. We are not responsible for the availability, accuracy, or content of third-party services. 

17. Changes to the Service or Terms 

We may modify the Service or these Terms at any time. We will notify you of material changes via email or dashboard notification. Continued use of the Service after changes constitutes acceptance.
